Over the past several years, healthcare has been profoundly altered by the growth of managed care. Because managed care integrates the financing and delivery of healthcare services, it dramatically alters the roles and relationships among providers, payers, and patients. While analysis of this change has focused on whether and how managed care can control costs, an increasingly important concern among healthcare providers and recipients is the impact of managed care on the physicianpatient relationship, but little data have been collected and (...) analyzed. We designed a survey for distribution to Wisconsin physicians to analyze the prevalence and types of managed care arrangements in the state, and the impact of these arrangements on physicians and their relationships with patients. In our article, we share the lessons we have learned after creating and running a successful legal laboratory over the past seven years at Yale Law School. Our legal laboratory, which focuses on the intersection of law and severe brain injury, represents a unique pedagogical model for legal academia, and is closely influenced by the biomedical laboratory.

One of the first volumes in the new series of prestigious Oxford Handbooks, The Oxford Handbook of Jurisprudence and Philosophy of Law brings together specially commissioned essays by twenty-six of the foremost legal theorists currently writing, to provide a state of the art overview of jurisprudential scholarship.

Employees’ may view prohibitive voice—that is, expressing concerns about harmful practices in the workplace—as a moral yet interpersonally risky behavior. We, thus, predict that prohibitive voice is likely to be influenced by variables associated with moral and relational qualities. Specifically, we hypothesize that employees’ moral identity internalization—i.e., the centrality of moral traits in their self-concept—is positively associated with their use of prohibitive voice. Furthermore, we hypothesize that this association is stronger when employees enjoy a higher quality relationship with their leader. (...) In addition, drawing on the literature on moral symbolism, we hypothesize that workgroup moral identity symbolization—i.e., the extent to which workgroup members symbolically display moral traits—moderates the relationship between moral identity internalization and prohibitive voice in a compensatory manner. That is, workgroup moral identity symbolization enhances employees’ use of prohibitive voice when employees’ moral identity internalization is low. Data collected from hospital employees and their supervisors and coworkers support these hypotheses. These findings suggest new ways to promote prohibitive voice and, thereby, protect organizational stakeholders from harmful behaviors. (shrink)

Recreational Drugs European Network (ReDNet) project aims to use the Psychonaut Web Mapping Project database (Psychonaut Web Mapping Group, 2009) containing novel psychoactive compounds usually not mentioned in the scientific literature and thus unknown to clinicians as a unique source of information. The database will be used to develop an integrated ICT prevention approach targeted at vulnerable individuals and focused on novel synthetic and herbal compounds and combinations. Particular care will be taken in keeping the health professionals working directly with (...) young people showing problematic behaviors regularly updated in terms of novel compounds and combinations as well. A user-friendly project website will be developed aimed primarily at delivering the information/prevention approaches, but will also be a way of communicating with project partners and relevant stakeholders (e.g. thematic forum facilities, instant messages, blogs, video chat, wikiblog, newsletters distributed via mailing list). The website will support various ICT prevention tools, including an SMS alert service. Different areas and sections will be aimed specifically at the different target groups. -/- . (shrink)

Medical school curricula, although traditionally and historically dominated by science, have generally accepted, appreciated, and welcomed the inclusion of literature over the past several decades. Recent concerns about medical professional formation have led to discussions about the specific role and contribution of literature and stories. In this article, we demonstrate how professionalism and the study of literature can be brought into relationship through critical and interrogative interactions based in the literary skill of close reading. Literature in medicine can question the (...) meaning of “professionalism” itself, thereby resisting standardization in favor of diversity method and of outcome. Literature can also actively engage learners with questions about the human condition, providing a larger context within which to consider professional identity formation. Our fundamental contention is that, within a medical education framework, literature is highly suited to assist learners in questioning conventional thinking and assumptions about various dimensions of professionalism. This field survey in a fast food restaurant setting tested the hypothesized influences of two social context variables (role responsibility and interests of group members) and justice evaluations (distributive, procedural, and retributive) on respondents' inclination to report theft and their theft reporting behavior. The results provided mixed support for the hypotheses. Inclination to report a peer for theft was associated with role responsibility, the interests of group members, and procedural justice perceptions. Actual reporting behavior was associated with the inclination to (...) report and with retributive justice evaluations. Implications for future research and for management are discussed. (shrink)

Quite unexpectedly, cognitive psychologists find their field intimately connected to a whole new intellectual landscape that had previously seemed remote, unfamiliar, and all but irrelevant. Yet the proliferating connections tying together the cognitive and evolutionary communities promise to transform both fields, with each supplying necessary principles, methods, and a species of rigor that the other lacks. (Cosmides and Tooby, 1994, p. 85).

In this paper, I present a new argument against inclusive legal positivism. As I show, any theory which permits morality to be a condition on legality cannot account for a core feature of legal activity, namely, that it is an activity of social planning. If the aim of a legal institution is to guide the conduct of the community through plans, it would be self-defeating if the existence of these plans could only be determined through deliberation on the merits. I (...) also argue that, insofar as inclusive legal positivism was developed as a response to Ronald Dworkin's critique of H. L. A. Hart's theory of law, it was founded on a mistake. For once we appreciate the role that planning plays in legal regulation, we will see that Dworkin's objection is based on a flawed conception of legal obligations and rights and hence does not present an objection that inclusive legal positivists were required to answer. Though the “internal point of view” is perhaps H.L.A. Hart’s greatestcontribution to legal theory, this concept is also often and easily misunderstood. This is unfortunate, not only because these misreadings distort Hart’s theory, but, more importantly, because they prevent us from appreciating the infirmities of sanction-centered theories of law and the compelling reasons why they ought to be rejected. In this paper, I try to address some of these confusions. What, exactly, is the internal point of view? What role (or (...) roles) does it play in Hart’s theory? And how does an adequate appreciation for the centrality of the internal point of view lead to the rejection of sanction-centered theories? (shrink)

Using a survey of 393 employees who were natives and residents of China, Japan, and South Korea, we examined the extent to which employees from different countries within East Asia experience distributive justice when they perceived that their work outcomes relative to a referent other were equally poor, equally favorable, more poor, or more favorable. As predicted, we found that when employees perceived themselves relative to a referent other to be recipients of more favorable outcomes, Chinese and Korean employees were (...) less likely than Japanese employees to experience distributive injustice. We also found that these differences were partially mediated by employees’ level of materialism. Theoretical and practical implications of our findings are discussed. (shrink)

The number of women living with HIV/AIDS is increasing worldwide, and there is an urgent public health need to develop new user-initiated HIV prevention methods, including microbicides. Although funding for microbicide development has increased since 2000, financial support is provided predominantly by governmental agencies and private foundations. Many donors, including the US Agency for International Development (USAID) and the US National Institutes of Health (NIH), have policies that restrict how research funds may be used. Among these are the now-rescinded Mexico (...) City Policy, elements of the US Foreign Assistance Act, and restrictions on non-study-related care. The effect of these restrictions on the design and conduct of clinical research is poorly understood. As part of a recent mapping exercise conducted by the Global Campaign for Microbicides, we reviewed the impact of donor restrictions on seven HIV prevention trials. We found considerable confusion within the HIV prevention field as to whether and how Mexico City and other policies affect the use of research funds. We also found that these donor-imposed policies limited the level of care provided to trial participants and the types of capacity building projects undertaken. (shrink)

There is a standard objection against purported explanations of how a language L can express the notion of being a true sentence of L. According to this objection, such explanations avoid one paradox (the Liar) only to succumb to another of the same kind. Even if L can contain its own truth predicate, we can identify another notion it cannot express, on pain of contradiction via Liar-like reasoning. This paper seeks to undermine such ‘revenge’ by arguing that it presupposes a (...) dubious assumption about the linguistic expression of concepts. Successful revenge would require that there be a notion other than truth that plays the same role with respect to concept-expression that truth is naturally thought to play before we are confronted with the Liar paradox. This project continues our interdisciplinary research into computational and cognitive aspects of narrative comprehension. Our ultimate goal is the development of a computational theory of how humans understand narrative texts. The theory will be informed by joint research from the viewpoints of linguistics, cognitive psychology, the study of language acquisition, literary theory, geography, philosophy, and artificial intelligence. The linguists, literary theorists, and geographers in our group are developing theories of narrative language and spatial understanding that are being tested by the (...) cognitive psychologists and language researchers in our group, and a computational model of a reader of narrative text is being developed by the AI researchers, based in part on these theories and results and in part on research on knowledge representation and reasoning. This proposal describes the knowledge-representation and natural-language-processing issues involved in the computational implementation of the theory; discusses a contrast between communicative and narrative uses of language and of the relation of the narrative text to the story world it describes; investigates linguistic, literary, and hermeneutic dimensions of our research; presents a computational investigation of subjective sentences and reference in narrative; studies children’s acquisition of the ability to take third-person perspective in their own storytelling; describes the psychological validation of various linguistic devices; and examines how readers develop an understanding of the geographical space of a story. For the past four decades, Anglo-American legal philosophy has been preoccupied – some might say obsessed – with something called the “Hart-Dworkin” debate. Since the appearance in 1967 of “The Model of Rules I,” Ronald Dworkin’s seminal critique of H.L.A. Hart’s theory of legal positivism, countless books and articles have been written either defending Hart against Dworkin’s objections or defending Dworkin against Hart’s defenders. My purpose in this essay is not to declare an ultimate victor; rather it is to identify (...) precisely the core issue around which the debate is organized. Is the Hart-Dworkin debate, for example, about whether the law contains principles, as well as rules? Or does it concern whether judges have discretion in hard cases? Is it about the proper way to interpret legal texts in the American legal system? Or is it about the very possibility of conceptual jurisprudence? Although trying to capture the essence of a philosophical debate can be tricky, I think that there is an important unity to the Hart-Dworkin debate that can be described in a relatively straightforward manner. I suggest that the debate is organized around one of the most profound issues in the philosophy of law, namely, the relation between legality and morality. Dworkin’s basic strategy throughout the course of the debate has been to argue that, in one form or another, legality is ultimately determined not by social facts alone, but by moral facts as well. This contention directly challenges, and threatens to undermine, the positivist picture about the nature of law, in which legality is never determined by morality, but solely by social practice. As one might expect, the response by Hart and his followers has been to argue that this dependence of legality on morality is either merely apparent or does not, in fact, undermine the social foundations of law. The Hart-Dworkin debate, I also try to show, is not a monolithic entity. In the second half of the paper, I describe how Dworkin modified his critique to circumvent the responses of Hart’s followers, thereby inaugurating a new phase in the debate. Virtually no attention, however, has been paid to this latter challenge, which is especially surprising given that none of the previous positivistic defenses are helpful against it. I then sketch out a possible response positivists might offer to this extremely powerful objection. (shrink)

In this paper, I examine Marie Thiroux D’Arconville’s moral psychology as presented in two of her works: Des Passions [On the Passions] and De L’Amitié [On Friendship]. This moral psychology is somewhat unique as it centers human action on three principal sentiments: l’amour, which is best understood as lust or a physical love; l’ambition, the principal human vice; and l’amitié, a characteristic friendship proper to the truly virtuous. I aim to show that these three passions tell a story of moral (...) development. Through l’amour we come to form projects and engage in goal directed action, and thus become moral agents. While l'ambition is, for her, the cause of many of the horrors of human history, I suggest that Thiroux D’Arconville also sees it as the passion through which we come to form collective projects. Finally, in her account of l’amitié we can find her account of virtue. Interestingly, while Thiroux D’Arconville talks of virtue as a matter of choosing well, she does not offer a voluntarist account of choice. Rather, I argue, she models moral choices on a naturalist Stoic model. I will also discuss Thiroux D’Arconville’s very interesting remarks on relations between men and women, including those regarding sexual desires, marriage, and friendship. (shrink)

In his early writings, he adopted the Christian perspective according to which postlapsarian nature cannot by itself yield a juridical order, or in his poetic phrase, “life is not a mushroom growing out of death.” Yet—in accord with Catholic doctrine—he also found sources of life, or law, in this world. While he repudiated theories of collective self-legislation, he embraced a popular sovereign empowered to impose form on a chaotic society. In Political Theology (1922), he compared the form-giving power of the sovereign to an act of divine intervention. Law, he argued, can only function in a lawful or “normal” situation that precedes formalization, and the sovereign “produces and guarantees the situation in its totality” [13]. In The Crisis of Parliamentary Democracy (1923) Schmitt retained his theological terms: “A scientific study of democracy must begin with a particular aspect that I have called political theology” [32]. In the modern age, democratic constituent power (pouvoir constituant) replaces the will of God as the transcendent source of a substantial order, namely democratic homogeneity. Democratic will-formation thereby becomes an act prior to its subject, or as Schmitt wrote, “[...] only political power, which should come from the people’s will, can form the people’s will in the first place” [Crisis 28]. A variety of democratic theorists dwell on the paradoxical character of democratic sovereignty, sometimes tracing it back to Rousseau’s well-known formulations [see esp. Connolly and Honig]. They highlight the gap between a transcendent (ideal or fictive) will in whose name political power acts, and the bounded, material consensus it forms, ostensibly rendering the latter vulnerable to challenge. As I argue, however, a closer look at Rousseau’s discussion of democratic founding in On the Social Contract reveals instead a dynamic relay between dispersed substantial or immanent sources of affiliation, on the one hand, and various agents and techniques of political power that draw on and combine them in a collective will, on the other, or what I call the virtual and the virtuosic.2 After briefly exploring this dynamic in Rousseau’s [End Page 121] On the Social Contract, I will highlight similar dynamics at work in Schmitt’s Weimar writings, examining three instances: the complexio oppositorum (1923), national myth (1923), and the polemical opposition of friend and enemy (1927), focusing especially on the first. Contrary to familiar readings of Schmitt’s metaphysical “exceptionalism,” I argue that for Schmitt, as for Rousseau, political power does not create a normative order from a vacuum, and the apparent transcendence of sovereign authority has a variety of worldly sources.3 Finally, I consider what I call “democratic virtuosity,” or virtuosity from below, focusing on Walter Benjamin’s repudiation of sovereign acts of lawmaking or law preserving in favor of ongoing collective habit-formation. Rather, I suggest, this strand of (...) thought is connected with a central philosophical question of the early modern period, the nature of thought and consciousness. Before there was the digital divide there was the analog divide– and universal service was the attempt to close that analogdivide. Universal service is becoming ever more complex in terms ofregulatory design as it becomes the digital divide. In order to evaluatethe promise of the next generation Internet with respect to the digitaldivide this work looks backwards as well as forwards in time. Byevaluating why previous universal service mechanisms failed andsucceeded this work identifies specific characteristics ofcommunications systems – in particular (...) in billing and managinguncertainty – and argues that these characteristics underliesuccess or failure in terms of technological ubiquity. Developing a setof characteristics of services rather than a set of services is afundamental break with the tradition of universal service. In fact, theimplications of our proposal is that basic characteristics in theoffering of the service rather than the absolute price are critical toclose the digital divide: certainty of total charge, ability to avoiddeposits or disconnection via best effort service, and payer-basedcontrol of all charges. While all of these principles sound obvious infact none of these hold in the telephony network. Universal service hasevolved from common carriage (serve all with no discrimination) to aright to basic services (100% penetration). Universal service isnow discussed as the digital divide, as the access to information asopposed to services becomes increasingly critical. However, we arediscussing in this paper access to the bits and the network rather thanaccess to the information (or intellectual property) once connected. Theprovision of universal service is seen as a technical problem only in thatthe technology costs money – universal service debates have longbeen the domain of economists. Yet the design of protocols has been thedomain of engineers, the building of systems the corporate domain, andthe discussion of equity the interest of ethicists. The design ofprotocols can define the parameters of the corporate decision-makers,the variables of the economist, and the questions for the ethicist. Thedesign decisions made at the fundamental levels can make communicationsequity more or less likely. In this work I focus on the design ofprotocols for the next generation Internet, protocols which willfundamentally change the best-effort nature of Internet services.Building on the economic and ethnographic work of others I argue thatthe effects of protocols adoption on universal service can be predictedto some degree. By examination of past and current technologies Iexamine a set of technical mechanisms to determine how such mechanismsmight harm or enhance universal service. I define each mechanism (e.g.denial of entry) and offer observations about each particularmechanism''s implicit pricing assumptions. I close with a discussion ofinterest to ethicists and regulators on evaluating communicationsprotocols with respect to universal access. Protocols for developingmultiple qualities of service for packet-switched networks have focusedon economic efficiency (e.g. Mackie-Mason, 1995; Choi, Stahl &Winston, 1997; Shapiro & Varian, 1998), billing to encouragewidespread adoption of network innovations (e.g. Xie & Sirbu, 1985)and billing in a manner consistent with the underlying network (e.g.Clark, 1996). In lieu of an abstract, here is a brief excerpt of the content:258 HISTORY OF PHILOSOPHY To make this theme conspicuous to the reader, the author deals with three topics in Aristotle's first philosophy: the path from beings to the primary instance of being, the study of sensible substance, and the distinction between the potential and the actual. Grene's essay on the most perplexing of Aristotle's works is the least satisfactory in her study. Though she acknowledges that the path of (...) thg Aristotelian first philosopher is not easy, her analysis of the school X67oLmakes the road more facile than it, in fact, is. For example, what is the relation between Wisdom (the science of principles and causes), the science of being-qua-being, and the science of immovable substance? How can the latter be universal and, at the same time, have as its object one kind of being? Why does Aristotle dismiss substrate in the sense of compound of form and matter as a candidate for substance? It would seem to satisfy his criteria of thisness and separability better (or at least in more instances) than substrate in the sense of form. Finally, it is hard to avoid Ross's conclusion (Aristotle's Metaphysics, Vol. 1, pp. ci) that Aristotle in Book Z moves away from the view that the primary ontological units are sensible individuals toward the view that they are pure forms. The real is either the object of definition (and this appears to be Aristotle's view for the most part in Book Z) or it is the individual (the doctrine of the Categories); it cannot, on Aristotelian grounds, be both. Grene's resolution of the difficulty will not bear scrutiny. She says (p. 205): "Definition is of the universal. But the object of definition is the real substance, the being-what-it-is of the thing. This is substance and not universal." The incompatibility of the first and third sentences in this passage constitutes what Grene refers to (p. 205) as "a very perplexing situation indeed;" and they also reflect the "double meaning" which "pervades Aristotle's whole treatment of substance" (Ross, Aristotle, p. 166). It is the doctrine of the first sentence which comes to the fore in Book Z, for there Aristotle concludes (i) that ot~r is r6 I"L~Tv e~tL and maintains (ii) that rb rl ~v rival 'will belong to nothing which is not a species of a genus' (1030"12-13). And we hardly need be reminded that an Aristotelian species is not an individual. Grene, it seems to me, relieves our perplexity somewhat, but only by blurring the oscillation in Aristotle's mind on this point, e.g., when she implies that the unambiguous doctrine of Book Z is that "as far as the perceived world goes, the naturalist's specimen, the individual of a type, the member of a class, is the prototype of the real" (p. 205). In very readable prose Grene has given us a picture of Aristotle that is at once engaging and in most respects faithful to the interests and outlook of her model. She says in a bibliographical note that her book is "meant more for the undergraduate reader or the general public than for scholars already conversant both with the text and the tradition" (p. 257). In lieu of an abstract, here is a brief excerpt of the content:258 HISTORY OF PHILOSOPHY To make this theme conspicuous to the reader, the author deals with three topics in Aristotle's first philosophy: the path from beings to the primary instance of being, the study of sensible substance, and the distinction between the potential and the actual. Grene's essay on the most perplexing of Aristotle's works is the least satisfactory in her study. Though she acknowledges that the path of (...) thg Aristotelian first philosopher is not easy, her analysis of the school X67oLmakes the road more facile than it, in fact, is. For example, what is the relation between Wisdom (the science of principles and causes), the science of being-qua-being, and the science of immovable substance? How can the latter be universal and, at the same time, have as its object one kind of being? Why does Aristotle dismiss substrate in the sense of compound of form and matter as a candidate for substance? It would seem to satisfy his criteria of thisness and separability better (or at least in more instances) than substrate in the sense of form. Finally, it is hard to avoid Ross's conclusion (Aristotle's Metaphysics, Vol. 1, pp. ci) that Aristotle in Book Z moves away from the view that the primary ontological units are sensible individuals toward the view that they are pure forms. The real is either the object of definition (and this appears to be Aristotle's view for the most part in Book Z) or it is the individual (the doctrine of the Categories); it cannot, on Aristotelian grounds, be both. Grene's resolution of the difficulty will not bear scrutiny. She says (p. 205): "Definition is of the universal. But the object of definition is the real substance, the being-what-it-is of the thing. This is substance and not universal." The incompatibility of the first and third sentences in this passage constitutes what Grene refers to (p. 205) as "a very perplexing situation indeed;" and they also reflect the "double meaning" which "pervades Aristotle's whole treatment of substance" (Ross, Aristotle, p. 166). It is the doctrine of the first sentence which comes to the fore in Book Z, for there Aristotle concludes (i) that ot~r is r6 I"L~Tv e~tL and maintains (ii) that rb rl ~v rival 'will belong to nothing which is not a species of a genus' (1030"12-13). And we hardly need be reminded that an Aristotelian species is not an individual. Grene, it seems to me, relieves our perplexity somewhat, but only by blurring the oscillation in Aristotle's mind on this point, e.g., when she implies that the unambiguous doctrine of Book Z is that "as far as the perceived world goes, the naturalist's specimen, the individual of a type, the member of a class, is the prototype of the real" (p. 205). In very readable prose Grene has given us a picture of Aristotle that is at once engaging and in most respects faithful to the interests and outlook of her model. She says in a bibliographical note that her book is "meant more for the undergraduate reader or the general public than for scholars already conversant both with the text and the tradition" (p. 257). A much-cited definition of placebo is from Shapiro and Shapiro :"any therapy that is intentionally or knowingly used for its nonspecific, psychological, or psychophysiological, therapeutic effect, or that is used for a presumed specific therapeutic effect on a patient, symptom, or illness but is without specific activity for the condition being treated". What nonspecific means and how it relates to the psyche has been written about extensively yet inconclusively.
